III. Transfer to third countries

If we transfer your personal data ourselves or via service providers to countries based outside the European Union, we shall comply with the relevant particular requirements of Article 44 et seq. GDPR and our service providers shall also undertake to comply with these regulations. We shall therefore only transfer your data to countries based outside the European Union subject to the level of security guaranteed by the GDPR. This level of security is guaranteed in particular on the basis of an adequacy decision by the European Commission or with suitable guarantees in accordance with Article 46 GDPR.

Data is transferred to third countries (countries outside the EU or the European Economic Area – EEA) if, for example, this
  • is required to fulfil a contract to which you are a contractual party or if this is required to respond to your requests;
  • is required to safeguard our legitimate interests;

If there is no European Commission decision for the country in question as to a level of data protection that is appropriate for European data protection requirements, we shall enter into corresponding contracts to ensure that your rights and freedoms are suitably protected. An agreement of this kind ensures that a suitable level of data protection exists at the data recipient, especially with the agreement on the European Union's standard contractual clauses with the recipient. Otherwise, we can also perform a data transfer based on your express consent. You can withdraw your consent with future effect at any time, see Section A.VII. We will be happy to provide you with more detailed information free of charge on request. Please use the aforementioned contact details for this purpose.

Where we permit the recipient to process data without a suitable level of data protection based on your consent alone, please note the following risks: There may not be sufficient measures in place to protect your personal data appropriately; there is no data protection supervisory authority; the implementation of your data protection rights of the data subject is impeded or has been disregarded; there is no control over the further processing of data by and transmission of data to third parties.

Any further information required can be found in our Separate Data Privacy Statement.

If you exercise your right to object, CLAAS will then cease processing your personal data unless CLAAS can provide compelling legitimate reasons for doing so which override your interests, rights and freedoms, or unless the processing is used to assert, exercise or defend legal claims.

2. CLAAS shall process your personal data for the purposes of direct marketing. You have the right to submit an objection vis-à-vis the processing of your personal data for the purpose of this type of marketing at any time.

If you object to your data being processed for the purposes of direct marketing, CLAAS shall cease using your personal data for these purposes.

If you have given your consent for your personal data to be processed, you have the right to withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of the processing of data on the basis of your consent before the time at which consent was withdrawn.

Consent can be withdrawn in any form. You can use the contact details provided in Section A.II. for this purpose. Should CLAAS provide any further options for exercising your right to withdraw consent (e.g. an unsubscribe link in any newsletter e-mail), you will be informed of these in the Separate Data Privacy Statement.

is responsible for the collection and further processing of personal user data on TikTok websites.

Please note that TikTok collects and processes certain information about your visit to our TikTok profile even if you do not have a TikTok user account or are not logged in to TikTok. For information on how TikTok processes personal data, please refer to TikTok's privacy policy at https://www.tiktok.com/legal/privacy-policy?lang=de.

Our profile is provided by TikTok in accordance with the applicable terms of use. We are solely responsible for the content posted on our TikTok profile (e.g. information about our company, products, services). TikTok is solely responsible for the technical operation of the profile. CLAAS has no influence on the data processing of TikTok.

Furthermore, it is not apparent to us to what extent, for what purposes and for how long the data is stored by TikTok and, if applicable, evaluated, linked and passed on to third parties.

II. Use of services

When you visit our TikTok profile and its contents, TikTok collects your IP address as well as other information that is available in the form of cookies on your PC. Please note that your data may also be processed outside the European Union/European Economic Area. In order to ensure an adequate level of data protection, TikTok bases such data transfers on the standard contractual clauses of the European Commission, unless there is a corresponding adequacy decision of the EU Commission for the third country concerned. IV. Interaction and communication between CLAAS and users

If you want to contact us directly, i.e. without participation of TikTok, please use the contact options on our website. If we cannot process your request because we have no influence on the data processing, we will forward your request to TikTok.

Please note that you use our TikTok profile and its functions under your own responsibility. This applies in particular to the use of the interactive functions (e.g. comments, sharing).

For us as the operator of this TikTok profile, only your public profile is available at TikTok. What information is visible here depends on your settings in your profile. In addition, we process your personal data (such as your name and the content of your messages, inquiries or other contributions to us) when you contact us via our TikTok profile. We then process this data for the purpose of processing your contributions accordingly and, if necessary, answering them. Depending on the occasion and content of the conversation, these processing operations are based either on our legitimate interest in accordance with Article 6 (1f) GDPR, in particular in order to be able to contact you in response to your inquiries or contributions, or on Article 6 (1b) GDPR, if your inquiry is aimed at concluding a contract with us.
